I for one...am strongly against it...
Anyone know enough about moving radar and how it's "supposed" to be used by the CHP, to know what it might take to beat it in Cali court (other than all the subpeona the radar cal and tuning fork mumbo jumbo)?
Let's say for example...
You're on your way to work one morning on your favorite canyon road...
It’s a straight section, broken yellow line down the middle, with a slight downward slope.
Posted speed is 55…and a guy you neeeeeeeeed to pass cuz he's gettin' in your hair is doing 45-50….no oncoming traffic…not even the CHP is in view yet cuz he was up around a right turn bend ahead and behind a hill and trees. No way for him to see you or you to see him...yet...
You nail the throttle and go around the Pokeman guy… you definitely had some speed going before you let back out :tongue:…that Grand National picks up speed fast.
After you are around the guy, you get back over to your side of the road and let off the gas and start to go for the brakes because there is that right hand turn coming up…the kind of turn that does not have a reduced suggested speed for it…so the speed limit remains 55mph….still no cop in sight. There are also hills and trees on both sides of the road, so the view around the turn is very obstructed.
About 200 yards from the turn…there the CHP is, coming around the turn and up hill in the opposite direction.

You hit the breaks harder…but not excessively….and look at your speedo. It just swept passed 65 and was slowing more before the cop was all the way out of the turn and he didn’t have any more time to react than you did.
So even if he had it in auto mode, the moving radar was still sweeping terrain due to the turn, and you are not straight up the road from him.
Your front bumpers were probably 50-75 yds from each other when he finally came out of the turn and straightened out.
You get off the brakes before you pass each other (so he did not see brake lights in his mirror) and know your speed entering the turn was about 60mph.
After you passed Chippy and you entered the turn you look in the mirror and saw his brake lights and knew he was getting ready to u-turn and come after you….so...you slowed all the way down to 55 and just waited for him cuz ruinnin' is dumb...
He pulls you over….sez his moving radar got you doing 80mph...
...and then he writes the ticket for 80.....no breaks from this bucket head....he's gotta bring in the revenue to save the state of Cali from bankruptcy...
Questions….
It’s your understanding that when using moving radar, the officer needs to take the time to check his patrol speed against the speed displayed by the radar before he can say...yup….gotchya. You know he was on the brakes before he had a good read on you because you saw his fornt end dip too….how could he get an accurate reading?
It’s also your understanding that to get an accurate reading using moving radar, the road must be straight and flat, and Chippy must be traveling straight at a consistent speed….there is no way he was going straight or at a consistent speed when he says he clocked you doing 80. Can you cry BS?
The conditions were safe…no other cars on the road but you and the guy you were passing….dry roads….nice sunny morning…well maintained vehicle…no side streets (this is a back road through the canyons)….well maintained road… etc….
His response was, "The radar can see you before you see it…"
...you know that…you used to be repair weapons control radar systems for a living….you also know that radar waves travel in a straight line and you need a clean line of sight to get an accurate reading out of them, and that there is error when the vehicle they are attached to is moving/turning and “sweeping” the terrain.
Can you beat this ticket and how?
It's been 23 months since your last ticket...so traffic school is an option...
But it might be worth going to court anyway to see if the judge will reduce the fine based on known errors that exist when usng moving radar...
