Moving Radar

I for one...am strongly against it...

Anyone know enough about moving radar and how it's "supposed" to be used by the CHP, to know what it might take to beat it in Cali court (other than all the subpeona the radar cal and tuning fork mumbo jumbo)?

Let's say for example...
You're on your way to work one morning on your favorite canyon road...
It’s a straight section, broken yellow line down the middle, with a slight downward slope.

Posted speed is 55…and a guy you neeeeeeeeed to pass cuz he's gettin' in your hair is doing 45-50….no oncoming traffic…not even the CHP is in view yet cuz he was up around a right turn bend ahead and behind a hill and trees. No way for him to see you or you to see him...yet...

You nail the throttle and go around the Pokeman guy… you definitely had some speed going before you let back out :tongue:…that Grand National picks up speed fast. :cool:

After you are around the guy, you get back over to your side of the road and let off the gas and start to go for the brakes because there is that right hand turn coming up…the kind of turn that does not have a reduced suggested speed for it…so the speed limit remains 55mph….still no cop in sight. There are also hills and trees on both sides of the road, so the view around the turn is very obstructed.

About 200 yards from the turn…there the CHP is, coming around the turn and up hill in the opposite direction.

You hit the breaks harder…but not excessively….and look at your speedo. It just swept passed 65 and was slowing more before the cop was all the way out of the turn and he didn’t have any more time to react than you did.

So even if he had it in auto mode, the moving radar was still sweeping terrain due to the turn, and you are not straight up the road from him.

Your front bumpers were probably 50-75 yds from each other when he finally came out of the turn and straightened out.

You get off the brakes before you pass each other (so he did not see brake lights in his mirror) and know your speed entering the turn was about 60mph.

After you passed Chippy and you entered the turn you look in the mirror and saw his brake lights and knew he was getting ready to u-turn and come after you….so...you slowed all the way down to 55 and just waited for him cuz ruinnin' is dumb...

He pulls you over….sez his moving radar got you doing 80mph.:eek:..

...and then he writes the ticket for 80.....no breaks from this bucket head....he's gotta bring in the revenue to save the state of Cali from bankruptcy...

Questions….

It’s your understanding that when using moving radar, the officer needs to take the time to check his patrol speed against the speed displayed by the radar before he can say...yup….gotchya. You know he was on the brakes before he had a good read on you because you saw his fornt end dip too….how could he get an accurate reading?

It’s also your understanding that to get an accurate reading using moving radar, the road must be straight and flat, and Chippy must be traveling straight at a consistent speed….there is no way he was going straight or at a consistent speed when he says he clocked you doing 80. Can you cry BS?

The conditions were safe…no other cars on the road but you and the guy you were passing….dry roads….nice sunny morning…well maintained vehicle…no side streets (this is a back road through the canyons)….well maintained road… etc….

His response was, "The radar can see you before you see it…"

...you know that…you used to be repair weapons control radar systems for a living….you also know that radar waves travel in a straight line and you need a clean line of sight to get an accurate reading out of them, and that there is error when the vehicle they are attached to is moving/turning and “sweeping” the terrain.

Can you beat this ticket and how?
It's been 23 months since your last ticket...so traffic school is an option...
But it might be worth going to court anyway to see if the judge will reduce the fine based on known errors that exist when usng moving radar...

The Radar picked ur car up long before you saw his car and long before he saw urs apparently. Considering ur car was the only car on the road in that particular area there would be no reason for him to assume it was another vehicle in the same lane up ahead and there was no other vehicle for him to rule out as a possible violator based on what you have stated.

The more advanced Radar units have "Same lane" capability and can tune out vehicles traveling in the other lane or HIS lane in this scenero. That's something older units cannot do. With older units an operator would have to make sure the vehicle he was tracking was in fact the vehicle being clocked. You still do to some degree but it takes a lot of the human error out of it.

Also remember advanced Radar units can track in front, behind and oncoming while moving. KA band units will track the furthest.

I run radar at the bottom of a local hill where a school zone is located and can tell you for a fact that I pick up cars on Radar long before they are in sight. I have a unit with same lane capability.

It's not necessary to check ur patrol speed before clocking someone because the Radar unit itself is calibrating ur speed vs. the oncoming speed while moving and converting it to display on the unit itself.

I guess the question you have to ask urself is were you going 80 mph at some point when you passed said vehicle? If the answer is no then fight it. I have personally been to court atleast (25) times for Radar and Laser and have yet to loose.

There just isn't much to contest unless you can prove the Radar itself has not been certified within whatever time frame CHP requires.

You can plead ur story in court and try to explain what happened but without the prosecutor actually being there to see what ur trying to explain I think it's waste of time personally.

The road MUST have a report of survey on record, ( road must be surveyed to determine average speed, and if speed limit is correct for circumstances, road conditions)
Operator must have FCC license, and be current.
Operator must have proper training ( and proof of it)
Radar unit must be in calibration, and operator must have checked calibration at beginning of shift.
all the above must be subpoena'd as evidence

If it was me, and I knew about the workings of radar, I'd baffle the judge with BS to make him believe the posibility of error was great enough to cause doubt!.

Some how I think 80 isn't gonna make the cut.....:p That's interesting about the FCC requirement. Never heard of such a thing. That goes to show how different states are from state to state.
 
I think that you had better start saving your quarters.
Let's see:
The LEO's probably been a LEO for 16 years. He's probably been working radar for about 15 of those years. He probably has a 97% record of wins in court.
He's probably written / issued almost as many moving violation tickets as months you've been alive, maybe almost as many days.
And let's see here, the normal suspect hasn't had a moving violation in 23 months.
The scales of justice aren't going to balance very well on this one.

Is 80 mph on a non LAH considered a Misdemeanor in Kali? Anything over 60 mph here is a Misd. as long as it's not an LAH. 86 mph and up is a misd. on a LAH.
 
I got popped the same way by CHP on the 73 heading to the 405 coming down the grade after the toll. Officer said I was traveling 97 mph,ticket cost me 364.00 dollars.

How long ago was that? I would have thought that it would have cost a lot more than that.

It's an "Infraction"
...but if they decide you were being reckless...they can up it all the way up to Felony and completely rape you.

Anything 15 over the posted limit can be called reckless, if the conditions are dangerous.

I'm somewhat impressed, maybe you shoulda done that for the CHP,
I'm sure he would of cut you some slack.

Nope I'm sticking with sheep for now. I don't like the way chickens drag their beaks & they are high maintenance.

I wasn't even so pissed about the ticket itself as much as the fact that it broke my five year streak with a perfect record. I did a lot of stupid stuff in high school, and had wised up and worked very hard to clean up my act.

life's not fair sometimes you just have to suck it up & get on with it. My last one was 14 months ago in Florida & feel I got baited by an undercover mustang going 90 in a 70 zone. But like I told the cop here I was in a turbo Porsche on vacation & I wasn't going to let anything short of going to jail spoil my fun.I was rather proud of myself to still be able to get a ticket for speeding instead of blocking traffic like the rest of the retiree's. We both had a laugh & it was part of the adventure. Online traffic school for four hours $200.00 total cost & it was off my license. I'm a lot more careful now. When your in a sports or muscle car lets face it your a target.It's not like we bought these cars just go to the market or church.My biggest hope is that meanchicken doesn't get soft & stop posting all them kills.That could put me out of business.
