How can you tell whether you have a lock-up converter?

I installed a 2nd torque converter when my first one was being repaired. This 2nd one was suposed to be a lock-up. I cannot get into OD for anything. Is it possible the torque converter is not a lock-up? How can I tell? It's a Street Brawler and the seller said he thought was a lock-up and is very willing to make it right if it is not. I just hate to have to drop the transmission again (4th or 5th time) if it's an easy fix. Does anyone have any ideas? I played around with the detent cable but I've had no luck.
 
once it is in top gear

touch the brake, you should notice an increase in rpm if L/U. keep your foot on the gas and lightly touch the brake. hope this makes sense.
 
Hi Chris,

It seems like its no 4th gear. I know you are the expert. Any advice on what I can do to get 4th gear? Can it have anything to do with the linkage? Any other type of adjustments like in the console? I replace the shift cable and the spring/grommet in the linkage (which were missing).
