Crooked Mitsu dealer in AZ wont sell an EVO for ebay auction price.

That's absurd! I have a buddy up here in the NW and he races his EVO from time to time at the local drag strip. Well there was a time that he needed something checked out by the Dealership and they refused him service becasue the dealership had somebody at the track writting down plate numbers and said he was abusing the car. How about that!:confused:

Needless to say he went to another dealership with no problems.
 
The bit about "I don't know if I can recommend Mitsubishi" is a little over the top. I doubt he's the go-to guy for car recommendations. It isn't a Mitsubishi problem, it's the dealership, but if they don't offer some help, it might be something to consider.

The auction shortcut

That internet sales guy is cutting him off to protect his job. He left off the reserve, didn't cancel the auction like he should have and didn't notify bidders when he had a sale on the car (which probably wasn't finalized yet).
Looks like they do reserve the right to cancel the bids, but they also noted that they would notify bidders, which they didn't do. I think the guy's raising a stink but will drop it before he gets anywhere. Mostly internet whining on boards he's never been on before. I DO hope the dealership loses some business over this, but it's their first auction, so I doubt they take it seriously. You should be careful of sellers with little/no feedback, just like buyers.
 
Looks to me like an open and shut case. The dealer still has it on their lot according to their website and has it listed for $39,995 which is $13,795 more than they legally sold it for on E-Bay. If the guy takes it to court he could easily argue that anything more than the price he won the auction for belongs to him. If E-Bay is a binding contract (which it is) then the car is sold as long as the buyer does everything right as far as attempting to pay etc..

I hope he burns the dealer as they are just showing their true colors on this one.

This should harken back to the old saying: "If it sounds too good to be true....."

It sounds like the dealership covered all of the bases when listing the auction but they left out that one crucial detail. A reserve price should have been listed, or better yet, just start the auction at a higher opening price.

A new Evo even without all of the fancy video gadgetry is worth more than $26K, the bidder knew that. If the dealership had followed through and honored that auction, someone got a helluva deal.

On some later threads someone had posted the dealer's inventory and that car is still on the lot.

The dealer screwed up plain and simple, should have either ended the auction or put a reserve on it or just a higher starting price, could have even bidded himself if he had to(probably not legal but neither is what he is doing now)
 
Someone would be have to be smoking some serious dope to pay $39.9K for an EVO VIII even with a $1K stereo/DVD player and some stripes :rolleyes:

They are nice cars, but that's about $12K too much.
 
I don't know how Arizona is, but in California, this guy would be in so much legal hot water by several agencies that he would be as red as a lobster by the time they were done with them. Whether they have to same car in stock still or not, you won a legatimate auchion, and they are refusing to honor it. If they do still have that car in stock for sale, then you have a very strong chance of making it very hard on them. I would make an visit to they lot and see if it is there and then get the law involved.

The 'Net publicity doesn't mean squat to them. They probably don't even know what's going on. They're scumbags and they're not going go give this guy anything unless legal action - long and drawn out - is brought against them. eBay should go after them - they're the only party with the resources to force the dealer to honor their auction.

I've never been to a dealer who was anything more than a common thief and this is just more evidence of it. It's sad.

I really don't think anything is going to come of this. The guy is probably not going to take any real action to get something done. He put it on the internet thinking that would make a difference, which I don't think it will. Sure, a lot of people are looking at it, but it won't make a dent in the dealerships business. How many people in the actual area are seeing it? Not many. This is also the first, and probably last, auction the dealership will have on Ebay, at least, under that name. The only thing that will happen is the internet sales guy gets harassing calls for several days (he deserves it--and he's getting them) and that's about all. Not much of the NEW car buying population participates on these BB's to even see it. Maybe it'll attract more attention, but I doubt it. Do you really want everyone who gets screwed by a dealership to put it on the internet and spread it everywhere? That would be 1000's a day clogging things up! The guy needs to get serious to handle it, not do some BS smear campaign.
 
He may not get the car but the dealer might end up loosing 26K worth of sells from others who now will not buy from them.

I hope he gets the car I called the dealer and asked about the situation and was nice but they were very rude about this situation.
 
I refreshed it 3 times giving it 3 seconds in between. I got 7 hits, 6 hits then 12 hits..Thats 25 hits in 9 seconds :eek:
 
ebay auctions are a legal contract. you could actually take them to court and the court would award you the car plus pay you for attorney fees. I would handle it legaly...
 
a) Ebay is responsible as being a contract.

b) The dealer gets away with it and Ebay sues the dealer since Ebay is nothing more than an advertisement.

If someone bids on Ebay, they figure it is a legal contract and if this $tealership gets away with this, it will hurt Ebay so bad (due to all the people that have seen this) that it will have absolutely no meaning to alot of people.
 
I emailed the seller. All I wrote was CROOKS. Got a response from them saying bla bla fine print in ad etc...I sent them back a post from another board that had a list of all the car sites that have this thread going:

I sent the dealer a response, here is his reply.


NOTE

We reserve the right to notify bidders and cancel this auction AT ANY TIME

This is the exact language that appeared in our e-bay listing. We did
receive a bid from an outside source at a higher price and excersized our
right to pull the auction.

We did have another brand new red Evo in stock and offered it to the high
e-bay bidder for a similar price and have not heard back from the bidder.
