I have a true story to tell. How I lost my GN @ Gbodyparts

So I started to ponder over the "who's insurance should cover this" argument over this and then had a thought. Anytime I have made a comprehensive claim on my car, one of the first questions they ask is if someone else caused the damage. In my case it was either a broken windshield due to a flying pebble or unknown a hole backed into my car at a place with no surveillance, or someone stole my stereo. I'd assume that if I told them that my car burned down while at a shop while they were working on it, they would investigate and go after that shop for damages if the shop was found at fault. When I worked at Sears Auto Center, we paid for any damages incurred to a car while we were working on it. I don't see how a smaller business would be able to be immune to this scenario and just tell the customer to go through their insurance. I would have personally gotten insurance involved immediately. Keeping them out of the equation is a bad idea no matter how good of friends you think you are with the person / buisness that caused the damage. It's a shame you didn't have collision / comp on your car, because you could have started the claim with them, and let them handle the rest.

The owners insurance premium would increase if he files a claim, regardless of who is at fault, right? 1. That could result in a total loss of the car; 2. That could result in him not being able to obtain a new "agreed value" car policy on this car or any other car; and 3. Why would anyone want to pay additional money for what could be someone's negligence?

Hopefully this can be resolved.

Not if it fell under the comprehensive underwriting which it may or may not. The burden of proof is just that. Thats why id let my insurance company hash it out.

#1 I would never weld on a car without unhooking the battery
#2 I would have removed all the interior before even touching the metal work
#3 if I caught a car on fire while working on it I would turn it into my insurance asap. Then build them a car better than what they had to began with

All I know is that once you file a claim on anything it always seems to haunt you. I just had a water damage claim on my rental house and ended up paying the money out of pocket ($5k with a $1k deductible) just to avoid having to file a claim. I figure I'll save it for when/if I really need it.

Gbody's insurance needs to cover it. I work at a body shop. I asked the boss today if I burned a car down who would have to pay for it, he said us. If it is vandalized or stolen in the parking lot, then the owners insurance has to cover it. I have been turned off by GBP's costumer service, the unprofessional appearance they had when I saw them at BPG afew years ago (drinking beer while selling parts at 10am), the fact that he is buying out NOS stock and jacking up prices. His work looks like the typical back yard butcher that gives the auto body industry a bad reputation. I am sure this thread will be closed and deleted soon.

When you have have minimum coverage you lose the support of your insurance coverage on comprehensive issues. I found that out the hard way when a young chick pulled in front of me while on her cell phone. Good luck Wendy, hope all goes well. As mentioned earlier, I saw the 10 am beer thing at BPG. It is a laid back slighlty partying event but as a vendor they might wanna be a little more discreet.

my .02 worth:
1) Everyone who says it's your fault and not Brians' would be singing a different tune if it were their car that caught fire.
2) Save all the pics that you were taking up until he told you to stop taking them...evidence, if it gets to that.
3) After getting nowhere with him for 2 years, now he is willing to help out because you told the story?
4) This is an unfortunate accident, I can't see where you were to blame for what happened. Good luck, hope you get 'er fixed.

You sir obviously are not affiliated with gbodyparts.

You are incorrect. You would only need to have comprehensive coverage for this to be covered. Liability and collision wouldnt come into play here.
I hope I am incorrect....

Wendy if you haven't yet at least tried to go to your insurance company you probably should.

At this point I'd say it's way past a insurance issue. I understand the 2 years though I had a car craft magazine car burn I was sick 6 months before I ever moved it

I can totally believe the ignorant run around, been through the BS on a much smaller scale.
Was also told in person when I handed over a poorly fitting DP "We'll make it right" and several weeks later I get my now rusty DP,dinged for full customs duty tax on my original price (wasn't listed as warranty repair on paperwork).
And....I get my original poor fitting DP back untouched.
Try phoning there, I guarantee you'll be inconveniencing them.

I must say I have also had a horrible time dealing with their customer service as well. I have bought a lot from them and have always tried to look past the customer service but that change based on what happens.

If I saw ANY vendor, drinking beer while "on duty" selling things that would be the last time I dealt with them, very unprofessional and tasteless.

Well it seems NOT filing a claim is haunting him, too.

I have no dog in this fight and hind sight is always 20/20, but why would you be DRIVING the car anywhere at all without having full coverage on it? Especially when you had all that money in upgrades and hard parts in it well before taking it to Brian?

If you had purchased full coverage, even if it turns out Brian's insurance ends up with the responsibility, you would have been made whole a long time ago.

Let this be a lesson to those of you without full coverage on your precious vehicles!

I insured mine with Hagerty for an "agreed value" the very day I bought it, $13K. I've easily been able to re-negotiate my policy as things changed until I hit the limit of 28K for a T type.(At least by Hagerty standards, I haven't shopped it around) I have much more than that in the car now but at least I'm covered to that point.

This is such a tragedy for all involved, I hope you guys can get it resolved to both parties' satisfaction.

I am sure a lot of people drive their cars w/o full coverage all the time, so bad argument bud, but I do agree, why not have full coverage, just some people elect to have a cheaper premium and take a risk but by no way is it the car owners responsibility if something happens under a vendors roof! IMO, GBP insurance should have covered this no problem so I just have no idea why GBP didn't just submit it and be done like a few people here have mentioned their previous employers would have.

Well I was asked by my employees who were here during the event not to even read the "True story", Which is total BS. Let me start with who hops on the band wagon with out knowing there is a second side to every story. SuperSix Mark Santiago who stole our business name by changing the e-mail address & embezzled me for $4500. Took my site down for 2 weeks. That is right I am not allowed to publicly discuss because he had me sign a paper under direst. You have balls idiot. Shane Grimsley can back this up he still has the e-mails as do I. Go back under your rock crack head. Don't like it sue me. Which is getting ready to happen here. I'm going to step away for a few minutes to calm down. but trust me I 'll be posting here shortly. He isn't the only one with pictures. Fire fighter my ass he never grabbed a extinguisher but wathched it burn for 5 minutes. Like I said I am going to walk away for a few. My employees weren't kidding.

First, my statement wasn't an argument, bud. Driving with liability only insurance is driving with no insurance for yourself, and that's just plain stupid, IMO.

Second, your "covered this no problem" statement only goes to show you to be pretty naive when it comes to business insurance. You have no idea that probably every one of the stores/dealers/shops where these guys worked never used the insuarnce to pay for repairs to vehicles damaged in their places of business. They just paid it out of store profits and took it as a loss because, like "a lot of people drive their cars w/o full coverage all the time" for a business owner to be able to afford a gargekeepers policy they more often than not purchase them with deductibles starting at $50 -75K. You have to mess up something pretty bad to make it worth filing a claim. So GBP would be coming directly out of pocket on this deal if he ends up paying.

There are always 3 sides to a story. Person #1's, Person#2's and the Truth.

None of us weighing in here know the whole story, we don't know Brian's side yet and the truth, well, "It's out there".

Like I said Quicksixxxx, I have no dog in this fight but until you can prove you know what your talking about and that you have a thorough understanding of how business insurance really works, don't come in here spouting off about how "easy" this all could be.

It's not.

Dont know the op, but i've met Brian briefly seems like an awesome guy and has a nice place. Interested in hearing both sides of the story for sure.
