The statute of limitations on this 3 years. There is still over a year left to take legal action. I'm hoping to avoid having to go that route. My plan for the car was to get an 'Agreed Value' insurance policy on it after it was appraised in its completed stage. It was going in for paint after this and then on to the appraiser. Why have you waited so long to take care of this situation and or air it out on here?

This should have been resolved in a month or so.

I didn't run to the internet to air this out before I gave him more than adequate time to resolve this without the exposure. Every option that was ever open is still open.

Why would you want to drag your "drama" into the public eye since you are clearly responsible for this mis-fortune as you did not have insurance on your property, and expect someone else to pay for it?

Insurance is a tool to protect you and your property in case of an accident, which you clearly state that.

One of my cars is fully insured for $25K with a premium under $200 a year, so the cost of insurance should NOT have been an obstacle since you had spent LOTS of $$$$ in upgrades?

Brian, or his help, were not negligent, as it was an ACCIDENT, and your insurance would cover that, not his.

Garagekeepers liability coverage is rather uniform throughout the country, if your car is stolen or destroyed in a garage fire, it is NOT covered unless you can prove negligence by the owner.

Another fact not very well known is most insurance companies will provide fire and theft on a vehicle is it is being restored, and not on public roads where liability comes into play.

Many in our society now want someone to fix their screw up, instead of taking responsibility for their own actions, or non-action? :(

But I could be entirely wrong and you had insurance, but chose not to use it, and that would show you to be an even bigger fool.

Nick I will not be side tracked into an argument with you on this. While I do not agree with your opinion, I respect it as yours. I do however want you to know that I have had an attorney look into it and according to North Carolina LAW he is responsible.

If I took my car in for an oil change and they forgot to put the plug back in I would expect them to make it right, not my insurance company.
 
This is a lose lose for all involved.....Nick as a business owner as soon as customer product comes under my control I was financially responsible for its safety. Most larger companies even request copies of you insurance to prove your limits are high enough to cover all aspects of there product in your house.
Sorry for Wendy's damage but I would be surprised if Brian doesn't have to repair it way or another. Sometimes the price of business sucks.

I just got off the phone with Brian, and the fire inspector's report shows the cause of the fire to be a wiring issue, NOT the weld area catching fire after sitting for 1/2 an hour?

The law does not automatically make him responsible, but you MUST prove he was at fault, or you will also be paying for his legal defense, especially if you had been working on your car's wiring in his shop just before the fire? :)

I did have a conversation with Brian just after the fire, and he was very willing to help you with this "accident", but after 2 years he would probably still offer some help, but after this public "cry for help" you expect him to just fix your mess, or you want to be vindictive and bring public pressure to help you now?

If I was Brian, I would say "bring it on", as you had your chance 2 years ago.

Since you did not state you HAD insurance and all this could have been avoided, you have confirmed my statement above, this is YOUR fault, not my opinion.
 
The fact is responsible or not. You should have had INSURANCE! whether its restored or in process of restoration. You clearly state you were driving the car back home. I dont agree with your decision on not having insurance. I can assure you one thing, if you were insured at the time of this tragic accident you wouldn't be having this problem.

It didnt sound like to me that he didnt have insurance but rather he didnt have full coverage.
