Copyright claim on YouTube - To be PO'd or Not

Wow, that's stupid. There's so many videos on that site of pirated TV shows and other stuff that clearly violates the rules, coming after someone for background music is kinda low. I will say, whenever I use a song in a video, I make sure to mention the artist and give credit.

I'm kind of torn on this issue......

I got a notice from YouTube that a video I had posted was identified as having infringed on UMG (Universal Music Group) copyrighted material. At first I was pissed because the video was mine - filmed by me in my own car. Then I realized that it was the audio that was the problem. The background music is by Fear Factory. I'd be allowed to keep the video up as long as UMG is allowed to track hits and advertise on the search pages when people find the video. I chose to delete it instead. When people search on VIDEOS they find my content - they're not looking for Fear Factory. Therefore, why should UMG profit from my VIDEO? On the other hand, their washed up artist did do a nice cover tune that I chose to put behind the video. It is their material, not mine.

I'd have been happy to give them credit for the material had they asked but instead they decided to pirate MY video for their profit. I guess I need to copyright my videos.

I put up another version without any background music. The sound of the turbo V6 is more entertaining than a one-hit-wonder anyway. What's even more sad is that their one hit was a cover of an old hit.

I would hardly call Fear Factory a one hit wonder.

You obviously don't listen to metal. They arguably changed the face of metal with their industrial/death metal sound. The Gary Neumann (sp?) cars remake came well after they had released several ground breaking albums in the Metal Genre.

But other than that, I agree with you. You can't use their music (the music company) but they want to use your video to help advertise their music

I hadn't heard of Fear Factory until their cover of Cars. I bought the album and the only song I could tolerate was that cover. To each his own. They were able to cross over to 'mainstream' (radio play) with that cover.

I fell out of touch with 'metal' after the late 80s so maybe that's why.

EDIT: I checked them out online. They've actually toured with bands that I listen to a lot. Not sure how I missed that. I let my anger with their label cloud my judgement.
